Resumen

El fenómeno del populismo punitivo ha sido abordado desde una multitud de ópticas priorizando unos aspectos u otros de un movimiento que, dejando atrás motivaciones jurídicas, se muestra abiertamente político. En este artículo proponemos, desde una perspectiva de este movimiento esencialmente cultural, un análisis que, ahondando en el discurso moral del neoconservadurismo norteamericano, de cuenta de la naturaleza moralizadora de este populismo penal. El análisis de los principales textos constitutivos del neoconservadurismo norteamericano nos permitirá mostrar que la deriva populista penal estaba ya inscrita en una penalidad moralizante que estos activistas planteaban como parte fundamental de una batalla cultural y política.
