Abstract


This paper analyzes the role of military courts in the strategy of repression, the planning and implementation of a policy of extermination, which was carried out by the military coup and the dictatorship of Franco. Still pending is the full legal rehabilitation of all victims of the dictatorship. The response of the Spanish State should proclaim the legal annulment of all the varied sentences dictated via the penal processes of Franco’s courts, and imposed upon Spanish Republicans and Democrats; i.e. the reparation demanded of Spanish State by International Treaties.
