On the one hand, it’s used to be defended the binding character of legal precedent (vertical) as an instrument to safeguard the value of security (and other legal values). But, on the other hand, Constitution establishes the independence of judges “bounded solely to law’s empire”. In this paper I put forward a harmonization of both viewpoints, by recognizing an ‘unconditional’ binding power to law and a binding power of precedent, but ‘conditioned’.
